

Resolute Law Group Achieves Major Reduction in Claimed Damages
Resolute Law Group’s client, The Defendant, testified the Plaintiff stalked him which ended up in an altercation at a Tim Hortons in Calgary. The Plaintiff claimed our client commenced an unprovoked attack on him and that he suffered well over $100,000 in bodily injury damages.
Resolute Law Group successfully argued the case, reducing the Plaintiff’s damages to $2,500. Resolute Law Group also successfully showed the Plaintiff provoked the Defendant, thereby further reducing the damages.
While the Defendant was successful in arguing that he was entitled to protect himself from the Plaintiff’s initial non-consensual physical contact, the Court found that the Defendant’s use of force in self-defence was not reasonable in the circumstances.
Given the overall result, limiting the Defendant’s financial exposure to approximately $2,100, Resolute Law Group mounted a successful defence.
